CHARLOTTE, N.C. - ncarol.com -- The Families First Corona Virus Response Act (FFCRA) is a federal legislation geared to provide additional paid leave for government employees that have been impacted by COVID-19. FFCRA is designed to:
1. Expand existing Family and Medical Leave Act (FMLA) temporarily (till December 2020) to cover leave needed for the care of children out of school due to COVID-19. Employees utilizing this leave will be paid the third week through the twelfth week of extended FMLA.
2. FFCRA provides two weeks of paid sick leave for childcare and other leave related to COVID-19 (in addition to what Mecklenburg County has already provided.)
The FMLA amendments and the new federal sick leave outlined above were created in separate and distinct sections of the FFCRA. Employees can use the two types of leave outlined above, either separately, or in some circumstances together. The FFCRA Response Act went into effect on April 1, 2020; provisions outlined will apply through December 31, 2020.

Qualifying Reasons Related to COVID-19 include:
1. Subject to a federal, state, or local quarantine, or isolation order related to COVID-19
2. Has been advised by a health care provider to self-quarantine related to COVID-19
3. Is experiencing COVID-19 symptoms and seeking medical diagnosis
4. Is caring for an individual subject to an order described in point 1, or self-quarantine as described in point 2
5. Caring for his/her child whose school, or place of care is closed (or child care provider is unable) due to COVID-19 related reasons (or)
6. Is experiencing any other substantially similar condition specified by the U.S. Department of Health & Human Services.
Paid Leave Entitlements
Generally, employers covered under the FFCRA Act must provide employees up to two weeks (80 hours, or part-time employees' two-week equivalent) of paid sick leave based on the higher of their regular rate of pay, or the applicable state, or federal minimum wage paid at:

1. 100% for qualifying reasons 1-3 (above), up to $511 daily and $4,110 total
2. 2/3 for qualifying reasons listed in points #4 and #6 (listed above), up to $200 daily and $2000 total
3. Up to 10 weeks more paid sick leave and expanded FMLA paid at 2/3 for qualifying reason listed in point #5 above for up to $200 daily and $12,000 total
