In a new statement to the press, the leading HOA management company provides insight into crafting community policies to address Airbnb rentals.
CHARLOTTE, N.C. - ncarol.com -- In recent years, Airbnb has practically become synonymous with short-term vacation rentals. The platform is popular among travelers, and among homeowners and real estate investors looking to generate some extra income. However, for those who live in HOA-governed communities, there may be some restrictions in place as to if and when short-term rentals are permissible. In a new statement to the press, Kuester Management Group provides some clarifying comments.
"Before homeowners start dreaming big about generating rental income, it's critical to check the guidelines for their HOA," comments Bryan Kuester, President of Kuester Management Group. "Simply put, many HOA governments have restrictive covenants in place that disallow short-term rentals."

Kuester recommends that homeowners who want to know whether their HOA allows Airbnb rentals start by consulting with the community's covenants, conditions, and restrictions, or CC&Rs. "These are basically the laws that govern life within a specific HOA," he remarks. "While CC&Rs vary from one community to the next, it is pretty common for HOAs to disallow any rentals for timeframes that are less than 30 days."
Additionally, Kuester notes that many HOA bylaws will disallow homeowners from using their property for business or commercial purposes. "Depending on local zoning laws, this may or may not prohibit short-term leasing or rentals," he explains.
Kuester says it's important not only for homeowners but specifically for HOA Board members to be aware of their community's guidelines for short-term rentals, and to enforce those policies with consistency. "You can't show any kind of partiality or favoritism," he notes. "Violations may be dealt with via a warning, and after that with fines, restricted HOA amenities, or even legal action."
