Kuester Management Group highlights strategies for consistent rule enforcement and improving compliance.
CHARLOTTE, N.C. - ncarol.com -- The HOA board develops rules and regulations that are in the best interest of the community as a whole, not individuals or select groups. As such, enforcement of these guidelines should be fair and consistent, holding everyone to the same expectations. The board should periodically review the CC&Rs to make certain rules are still relevant and enforceable, says Kuester. Any violations and actions should be immediately documented so that there is a record of the steps taken to address the issue. This can also demonstrate that the board followed proper processes and procedures should concerns arise.

While exceptions to the rules can occur, this should not be the norm. Ensuring everyone is held to the same standards and treated equally can reduce risk of selective enforcement issues. Members should not feel that they are being singled out or that problems are being ignored or overlooked.
Working with an HOA management company can be beneficial because community managers are a neutral party when it comes to rule enforcement. The board may feel more comfortable allowing a manager to oversee compliance and handling violation notices. A community manager can also assist the board in creating fair enforcement policies and procedures.
"The HOA board, members, and the community manager should all work together to ensure that rules and expectations are clearly stated, communicated, and enforced to maintain a more peaceable environment and minimize potential violations," says Kuester. "Compliance shouldn't be a once and done conversation; it should be an ongoing process."
